Legal
Terms of
Service.
These Terms govern your access to and use of the Tell mobile app and the website at telljournal.com (together, the “Service”). By creating an account or using the Service, you agree to be bound by these Terms.
1. Description of the Service
Tell is a voice journal. You say what’s on your mind, and Tell transcribes it, sorts it into tabs, highlights what actually happened and what is a guess, asks you a question, and shows your patterns over time. The Service includes voice recording, transcription, AI-written reflections, Go deeper questions, feelings, thinking-pattern detection (“tells”), monthly patterns and a Mind Profile.
2. Not a medical or therapeutic service
Tell is not a medical device, mental health service, therapy platform or substitute for professional care. It is built for ADHD minds and any busy brain, but it does not diagnose, treat or manage ADHD or any other condition. Its reflections and patterns are tools for personal self-reflection only.
- Tell does not provide medical advice, diagnoses or treatment recommendations.
- The reflections are written by AI and may be inaccurate, incomplete or not applicable to your situation.
- If you are experiencing a mental health emergency, contact your local emergency services, go to the nearest emergency room or call a crisis line right away. You can find one at findahelpline.com.
- You should not make health-related decisions based only on information from Tell.
- We encourage you to talk to a qualified professional about any mental health concern.
3. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and 18, you must have the consent of a parent or legal guardian to use the Service. By using the Service, you confirm that you meet these requirements.
4. Your account
- You are responsible for keeping your account credentials confidential.
- You are responsible for all activity under your account.
- You agree to tell us right away about any unauthorized use of your account.
- We may suspend or close accounts that break these Terms.
5. Your content
- Ownership: You keep full ownership of everything you create with the Service, including your entries, voice recordings and any text you type.
- License to us: You grant us a limited license to process your content to provide the Service to you, including transcription, reflections and patterns. We send a few details worked out from how you use Tell to our analytics service, as described in our Privacy Policy, never the content of your entries. We do not use your content for any other purpose.
- No monitoring: We do not monitor or review the content of your entries during normal operations.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose or in breach of any applicable law.
- Try to reverse-engineer, decompile or disassemble the Service or its technology.
- Try to access another person’s account or data.
- Use the Service to send malware, viruses or other harmful code.
- Use automated systems (bots, scrapers) to access the Service without our written permission.
- Resell, redistribute or sublicense access to the Service.
7. AI processing and audio consent
Tell uses third-party AI providers to transcribe your voice entries and write your reflections. By using the voice journal, you consent to your audio being sent to and processed by these providers for the sole purpose of producing your transcription and reflections. Today these are Google’s Gemini and Anthropic’s Claude, both run on Google Cloud and reached through OpenRouter. When you tap Listen, ElevenLabs reads a Go deeper question aloud; it receives only the text of that question. The current list of AI processors, with their data-retention terms, is in our Privacy Policy. Tell’s servers do not store your audio, and every request uses zero data retention, so the AI host does not keep your audio after answering.
Reflections, highlights and patterns are written by AI and are for personal reflection only. They are not clinical assessments, medical diagnoses or professional mental health advice.
- AI-written content may contain errors, misreadings or biases. Use your own judgment with anything it says.
- We do not guarantee the accuracy, completeness or appropriateness of any AI-written content.
- AI-written reflections are not professional advice of any kind: medical, psychological, legal or otherwise.
8. Subscription and payments
- Tell is free to start. Tell Plus is a paid subscription with extra features, described in the app at the time of purchase.
- Tell Plus may start with a free trial. If you don’t cancel before the trial ends, the subscription starts and you are charged.
- If you buy a subscription, you agree to pay the fees shown at the time of purchase.
- Subscriptions renew automatically unless cancelled before the end of the current billing period.
- You can cancel at any time through the App Store (iOS). Cancellation takes effect at the end of the current billing period.
- Refunds follow Apple’s App Store refund policies.
9. Intellectual property
The Service, including its design, features, code and branding, is owned by Tell and protected by intellectual property laws.
“Tell”, the Tell logo and related marks are our trademarks. You may not use them without our written permission. These Terms do not give you any rights to our intellectual property except the limited right to use the Service as described here.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, at telljournal.com/privacy. By using the Service, you confirm that you have read and understood it.
11. Disclaimer of warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not warrant the accuracy or reliability of any AI-generated content.
12. Limitation of liability
To the maximum extent permitted by applicable law, Tell and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service.
In no event shall our total liability exceed the amount you have paid us in the twelve (12) months preceding the claim, or one hundred US dollars ($100), whichever is greater.
This limitation applies regardless of the theory of liability and even if we have been advised of the possibility of such damages.
13. Indemnification
You agree to indemnify and hold harmless Tell and its officers, directors, employees and agents from any claims, liabilities, damages, losses or expenses (including reasonable legal fees) arising out of your use of the Service, your breach of these Terms or your breach of any rights of a third party.
14. Termination
- You may stop using the Service and delete your account at any time.
- We may suspend or end your access to the Service at any time, with or without cause, and with or without notice.
- When your access ends, your right to use the Service ends immediately. You may ask for your data to be deleted as described in our Privacy Policy.
- Sections 2, 7, 11, 12, 13 and 16 survive the end of these Terms.
15. Changes to these Terms
We may update these Terms from time to time. We will tell you about material changes in the app or by email. If you keep using the Service after the revised Terms take effect, you accept the changes.
16. Governing law and disputes
These Terms are governed by the laws of France and the applicable regulations of the European Union, including the GDPR.
Any dispute arising from these Terms or the Service is subject to the exclusive jurisdiction of the competent courts of Paris, France, except where mandatory consumer protection laws of your country of residence say otherwise. If you are a consumer in the EU, you keep the benefit of any mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of the country where you live.
You may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
17. General
- If any provision of these Terms is found unenforceable, the rest stay in full force and effect.
- If we don’t enforce a right or provision of these Terms, that is not a waiver of it.
- These Terms are the entire agreement between you and Tell about the Service.
